In North Carolina, parties that provide labor or materials to a construction project for property improvements have the right to file a mechanics lien if they are unpaid. Fill out the form above to download your North Carolina Claim of Lien Upon Funds Form, which is for use by sub-tier construction parties that did not contract with the property owner or GC.

North Carolina has three different types of mechanics liens available to construction parties. Only certain parties in North Carolina are allowed to file a mechanics lien on real property: prime contractors, and parties who contract directly with the prime. The mechanics lien available to subcontractors and suppliers is known as a “Lien Upon Funds.”
A subcontractor or supplier may deliver a Notice of Claim of Lien Upon Funds to any party “up the contract chain” once payment is owed to them. This includes, but is not limited to, the owner and general contractor.
Delivery of this notice “freezes” the funds in the hands of the party holding said funds. If those parties distribute the funds in spite of the notice, the distributing party may be personally liable to the notifying party.
