Virginia Notice of Bond Claim (Public Bond Claim) Form

This is a Virginia Bond Claim form (also referred to as a Virginia Notice of Bond Claim). This form can be filled out with a PDF editor or by hand after printing.

A Virginia Notice of Bond Claim form is used when a subcontractor or supplier is unpaid on a public project in Virginia, and would like to file a claim against the project’s payment bond. This notice is required from any party who contracted directly with a first-tier subcontractor (i.e. subcontractor hired by the prime contractor). Although not required from 1st tier subs, it may be a good idea to send one anyway.

This notice must be served on the prime contractor who provided the payment bond within 90 days after the last date of furnishing labor and/or materials to the project, by by registered or certified mail. Best practice would be to also send a copy to the public entity contracting the project and the surety who posted the bond, if known.
