A Missouri Notice of Rights form will rarely be required, but if the project property is to be sold, sending one may be mandatory. When an owner has posted or recorded a Notice of Intended Sale (which indicates the property will be sold), claimants must file a Notice of Rights at least 5 days before that sale closes in order to preserve their right to lien.
After completing the Missouri Notice of Rights Form, you must deliver it to the appropriate parties required by statute. Notices are typically served on the property owner and, for sub-tier parties, the general contractor. However, depending on the type of notice, it can be helpful to send notices to anyone else who is in charge of your payment, like a lender or surety company on the project.
