My parents hired a sub contractor and paid him $2,500 upfront for a $4,750 natural gas pipeline replacement. He dug the trench & has gone missing. I'm a general contractor who provides tree services to my customers. I was contracted by the occupant/owner (at least he said he owned the property and residence) of a residence located in St. Louis county, MO. After completing 90% of the job the occupant/owner sent a text message telling me not to come back and that he had moved the Bobcat I had rented to complete his job from his backyard out into the street in front of his residence and that I had better hurry if I wanted to retrieve said property. He also kept my climbing rope and carabineer as I had left them on the base of the tree I was planning on dropping that day (the day he sent the text telling me not to come back). He knew going into the job that it was a $3,500 contract of which he paid $200 cash on day 2 of the job. The day he said not to return would have been day 4 (and the final day) of the job. He will not acknowledge any invoices and ignores all attempts to call/speak with him. Since he refuses to communicate I began the process of putting a lien on his property during which I discovered he is not the owner of the property, his sister is. I am unsure how this effects my right to file a lien. So, can I put a lien on the property despite the fact that my contract was with the occupant, not the owner? And if I can, what do I need to do and how do I do it? If I can't put a lien on the property since the contract was made with the occupant not the owner what recourse do I have? Is there anything I can do to try to get him to honor our contract and pay his bill? ...Read More

I am the property owner of my residence in Palm Springs, CA and I hired SuperNova, / Norell Walker as my contractor to work on the landscaping and yard of my house. The total was $32K and he required that i pay him 2 payments total of $25K prior to the work being completed. This is for outdoor concrete pours, overlays and turf/rocks installation. We started the job on 4/4 and his subcontractor has not returned since 4/20 and I am left with a job about 40% done ($15k worth of work) and have paid already 78% of the project fee. I have attempted several times for weeks to contact the contractor and he has been avoiding my calls/emails/tests. He denies that I have paid him and he claims he has paid his subcontractor already. This contradicts what his sub has told me which is that Norell still owes him half the money. Furthermore, this contractor has previously been in trouble with the SEC for fraudulent activities, selling penny stocks in a scam company based out of Long Beach. https://www.sec.gov/litigation/admin/2017/34-81003.pdf I am looking to recoup my losses of $10K because I had to hire another company to finish and fix the work they did. We are getting ready to file lien(s) but this is a strange situation. I was first hired and contracted as a project manager to manage a commercial and residential renovation to then sell. I hired and contracted a contractor to do most of the work (construction, electrical, tile etc). In addition to my project manager role, I also did some of the painting and landscaping to reduce cost. All of my credit cards were used to fund the materials and myself and my contractor's contract stated we would be paid at the sale of the property. Midway through the reno, I was added to the property as a co-owner. Toward the late middle/end of the project/renovation, the investor and the original owner had a disagreement regarding the note (I was not on or added to just the title). The investor ended up taking the property, transfering title to just him and has said and threatened that he will NOT pay anyone or reimburse anyone for labor, time, job or contract(s). My first question is, because I was a contractor first with a contract but then became a co-owner, can I file a lien being owner? When I was added as a co-owner my contract with the original owner stayed in place and I continued to provide labor. Nothing changed there. My contractor is filing a lien against the investor/new owner as the investor/new owner is not continuing the reno or letting him in. I was told along with my contractor, I can file my own lien separately also, against the investor/new owner.....is this true? My second question is, if I can file a lien, would we both be considered GC's? Or is he the GC and I'm a sub? Or visa versa? This is a very complicated situation regarding ownership and contractors and just trying to get paid what I put in and are owned per contracts. Thanks in advance for your help. Good afternoon. I work for a general contractor, and we did some work for some clients after hurricane Laura. We have company insurance, bonded with the parish we worked in and did some small jobs. we also did a few jobs over the $7,500-dollar threshold and did not have a Louisiana contractor's license. After understanding the law, we contacted the Louisiana board of contractors and took the test and received our State Contractors license. I had a contractor build an addition on my house. The foundation was poured with multiple air pockets and weak spots which were never addressed before framing and completion of the addition. I had a second foundation company evaluate the safety of the foundation and they said that there were 3 vertical cracks over .25 inches for the entire length of the foundation. The floor Joyce’s were not supported by the brackets and the footings were not set correctly. The concrete has multiple air pockets which must be filled. I had the contractor address these issues but I am concerned that there are many other issues we cannot see in the foundation. I would like to know if this requires the entire foundation to be repoured and if the entire addition must be torn down. I have photo documentation of the entire build for evidence. I have before and after photos of the foundation repairs. Also, if I file a claim against the contractors bond, do I have to use the bonds recommended contractor or do they send me a check to hire my own contractor? Thank you in advance. ...Read More

We have completed our contract amount of 191,513.95 on a home damaged in Hurricane Michael The homeowner received 288,000.00 from insurance. The final inspection passed three weeks ago and the man assures us that the bank said the final funds of 78,000.00 of which 18,000 is to pay the public adjuster. will be available this week however he is indebted to us $125,198.00 and has not made a payment since September. Is there a form/contract that we can have him sign promising to pay the remaining amount due for materials and services performed?? I work for an excavation company. We don't use Levelset at the company I currently work for. The company that I used to work for used Levelset, and it was very helpful. Recently, I took over the billing at the company I currently work for and noticed that there are more than a few jobs that have unpaid invoices dating as far back as 2016. Our contract is fairly basic regarding client invoicing and payment, basically we will submit invoices every (30) days, client shall pay invoices in full within (30) days, If client fails to pay we may give (10) notice to client to secure the default, if they fail to do so, we can stop work.
