The girl from our office who signed our lien no longer works here and they are demanding she sign the release as well. On the Georgia lien waivers, there is language that says "WHEN YOU EXECUTE AND SUBMIT THIS DOCUMENT, YOU SHALL BE CONCLUSIVELY DEEMED TO HAVE BEEN PAID IN FULL THE AMOUNT STATED ABOVE, EVEN IF YOU HAVE NOT ACTUALLY RECEIVED SUCH PAYMENT, 60 DAYS AFTER THE DATE STATED ABOVE UNLESS YOU FILE EITHER AN AFFIDAVIT OF NONPAYMENT OR A CLAIM OF LIEN PRIOR TO THE EXPIRATION OF SUCH 60 DAY PERIOD." If we signed Interim Waivers and Release Upon Payment and we aren't paid, does that mean we need to file a lien for each progress waiver? What if the 60 days expire but my last furnishing date was less than 90 days ago so I'm still within my lien rights timeline?...Read More

Thinking that they were going to be appointed to administer property that was to go through a probate, lien claimants did work clearing out house cleaning back yard etc without ever being asked or requested or contracted for by the person who came to be the administrator, me. They filed an improper lis pendens which the probate court removed and the next day, through a straw man filed a mechanics lien. I never agreed, contracted or in any way requested them to undertake any work on the property, which has now been sold to a third party with court approval. I funded general contractor specifically to provide funds for him to pay supplier of concrete. General did not pay supplier and supplier is now threatening to lien my property. There was no signed contract between myself and anyone involved and therefore, no contract put on file at county recorders office. I found two liens that my company filed many years ago (2012 and 2002). They still appear to be attached to the property when searched on the county's assessors page. My understanding is that liens in Washington state expire after 8 months if not enforced. If so, why are these liens still attached to the properties? Do we have any obligation to remove these liens? Can we still enforce them now?...Read More

I am a property owner and tenants that I just evicted filed a "revenge" Mechanic's lien for many thousands of dollars against me, claiming that they did a lot of expensive work to the property (Nothing had been done, as a matter of fact they damaged the property, I did not give any consent for anything, seems to be a well organized scam done by people who are doing it for a living) I am selling the property and need the lien disputed and canceled asap, otherwise the escrow company will forfeit some of my money and deliver to the scam artists It is in Nevada Can you let me know what is the easiest way to dismiss this Lien?
