I'm being told a story and I can't understand how she thinks she can save the house. If I'm being told the truth, she claims she has 2 foreclosures. One is from her company they used their house as collateral. She says they called in loan. She also claims she is in foreclosure on her personal mortgage. From my understanding she owes 55 thousands on the mortgage and the business loan was a half a million. She is in forbearance. She says she's is getting it until March wich my understanding is it ends December all home covid programs end. We live in long Island NY. This question relates to California. Lets say a subcontractor works on a property July 1. A lender then comes in on August 1 and puts a lien on the property. If the subcontractor doesn't get paid and puts a lien on the property September 1, do they have priority over the lender because they performed work before the lender filed a lien?
Also, in many states, the subcontractor has a specific number of days to file their lien in order to get priority. Is there a time period in California?...Read More

As a design professional we completed drawings for a tenant, the space is located within a shopping center. We have a signed agreement and completed the submittal and obtained approval from the landlord. We have not submitted to the city due to lack of payment and construction has started without a permit. We are trying to collect on the remaining payment of $5000 and thought a mechanic's lien would be the best solution. Project is in Los Angeles.

We are filing a lien on a property and and the property consists of two separate buildings with two different addresses. The building we did NOT work on is the actual address attached at the auditor site and parcel information. The building we performed the work on is a totally different address. Concrete company does 6.4 million in work on a project in Collin County Tx. Last work was in December for DD Management, CEO is Ryan. 4 parcels of land included in the project with 4 different shell LLC names - all have the same managing member and/or CEO of the contractor - Ryan Ryan signed a promissory note in July 2022 agreeing to pay concrete company a minimum of $150k a week to keep him on the job and signed as CEO of DD Management and Owner of Platinum (mother company of all shell companies) - I believe this promissory note just wrapped Platinum into the mix as a responsible party. Ryan is CEO or Managing member of all companies involved: DD Management, Platinum, LLC Property owner 1, LLC property owner 2, LLC property owner 3, LLC property owner 4. One of the 4 properties is up for foreclosure Feb 7, 2023 I believe we are within rights to file a constitutional lien, followed by statutory mechanics liens. If I am correct in filing a constitutional lien, does the 6.4 million need to be seperated to a balance per parcel when it was excavation, dirtwork, and concrete on all 4 parcels of the project, or can the 6.4 lien be filed on each of the 4 properties? I feel that if he receives notice that mechanics liens are being filed, he will have 10 days to dissolve the companies, file bankruptcy, or make a move to shaft the concrete company out of 6.4 million.
