One invoice was for poor work which the contractor promised my wife and I would be refunded because he agreed the work was poor and not necessary ( because he sent a young trainee to our urgent response). The other invoice was a bit earlier which I was asking questions regarding the need for the work carried out and the Freon added (unnecessarily). I could not get email responses so I went to Amex - to get his attention. I assumed no issues with first invoice and just wanted a response to my questions for other invoice . I had 2 independent HVAC contractors review the work and state the Freon and work was unnecessary and probably not done (or not done properly). My emails to contractor got one response. He said “he does not do emails) and hence will not respond. This is when I went to Amex. Amex found in my favor and told me that the contractor voluntarily agreed with the finds of Amex and refunded my charges. Contractor then , a week later, issued notice of lien on my house if not paid in full . This included the invoice he promised my wife and I that he would refund. What are my options. He has obviously done this before because Amex has confirmed that a few contractors now do this to take Amex out of the loop and go straight to the home owner. My point is that I did pay. Amex then disputed charge directly with contractor and contractor refunded. This should be done and dusted. Contractor did not have to refund to Amex if they were convinced that their charges were correct. They decided to do so. Their lien states that I have not pain for services carried out . I have received a partial payment from a property own. His son initially reached out to my company and set up the job. All documents required by MN were sent by the deadline(s). It was an emergency after a storm with an insurance payment. We were short payed by 30%. All attempts to settle were made prior to the mechanic's lien being filed. The customer still refuses to pay the balance owned. I would like to pursue this with a lien foreclosure. Hi, we did a commercial job in phases, the first phase went ok but last june we started the last phase and did some work between june and december 2021 that havent gotten paid for. we were hired directly by the owner. no formal contract, just proposals and she would just accept and sign them. we hired an attorney in januarry 2022 to file a mechanical lein, the mechanical lien was filed and we sent her notices but we havent hear anything yet . the construction is not completed and we have an open permit with the city for the irrigation system that we cant close becuase the job isnt done yet. I have a customer who avoid paying me $16k, the job is finished and he keep dragging the payments by claiming he don't have money.
I already filed a mechanical lien and again he said he will pay but didn't.
He did gave me previously 4 checks of total $16k however they all bounced.
What will be the best and cheapest route for me, to continue with the lien and file a foreclosure on it or to sue in court for giving me bad checks knowing he don't have money?
