This is a third party lien collecting company, who holds money in a trust (?) and then releases payment once an unconditional is signed. Is this safe? Hello. I am the homeowner on a large project. I had a contractor who hired sub contractors. I thought that we were on the same page, that we would get a Lien Waver, from each subcontractor, BEFORE we submitted FINAL PAYMENT to the major contractor.
They are acting as if they do not know what a Lien waver or Release of Lien is.
They gave me one to sign. I thought it was the SUBCONTRACTORS who needed to sign ? Please help? Thank you....Read More
I have a question about conditional waivers. A lot of general contractors don't pay invoices within 30 days and at the time of submitting a new invoice (which requires the inclusion of a new conditional/unconditional lien waiver), more than the current month's billing is still outstanding. If this is the case, should the total amount outstanding be put on the conditional waiver, with the through date of the current billing period, rather than just the amount of the current billing? Or are the prior billed & unpaid amounts covered by the conditional waivers that were included with those billings? It just feels wrong to put only the amount of the current billing on the conditional waiver with a through date of the current billing, if the previous billings are still outstanding. - Main Contractor failed to provide the mandatory Disclosure Statement RCW 18.27.114 leaving us the Owners with no knowledge whatsoever about Washington State principle of Mechanical liens protecting Subcontractors payments
- No Subcontractors provide us the Owners a Notice of Right to Claim Lien within 60 days from first delivering labor or materials to Main Contractors
Q1: Can Subcontractors put a Mechanical Lien on our Property for not being paid by Main Contractor we paid in full for the Work complete by Subcontractors?
Q2: Main Contractor’s debt to Owners ran ~$K40 what are options to Owners for getting paid? To enforce collection of Owners Credit?
