My final payment was due on or around April 17 2023- the client stated becoming unreasonable after we fixed an item that was initially done incorrectly. We had a field rep from the product come out and say that we did everything in our power to resolve it. We did replace the siding in a commercial building. When we finished the job, they fired the manager (who presented himself as the owner of the business) and now the real owner (that is a common trust) don't want to pay because we don't have a written contract and change of orders. We did received a check as deposit and we have the building permit and hearings as we had to get a special permit to replace the siding. I have had work done by a landscaper to cut trees chip the brush and remove the wood. The landscaper subcontracted the tree cutting work and I paid the landscaper a portion of the total cost so he could pay the subcontractor. The remainder of the balance was $1, 000 to be held back until the landscaper removed the wood and finished clearing the brush and chipping it. It's been over a month and he still hasn't completed the work. We have been texting back and forth and I've left phone messages and he still hasn't completed the work. He said he was going to show up yesterday and complete the job and he never showed up. So I told him that's it I'll get someone else to do the work and then I'm not paying him. He now says he's going to put a mechanic's lien against my property. Can he do that and does he have a case. We are a mold remediation company in MA and performed work in RI. Customer is refusing to pay the balance ($14K). Remediation does not require licensing or building permits; we removed moldy building materials, insulation, etc and cleaned all surfaces.
