We have a project that we completed for a brewery located on an apartments property. We attempted to collect payment for the project that we had completed about 3 months ago but were told that they (brewery) was waiting for a payment from the apartment complex before they would pay us. We filed a lien on the apartment to ensure we would get paid, but the Brewery says that the apartment won't give the brewery their disbursement now because we filed a lien. So they asked us to release the lien so the apartment will pay them and then they will pay us. As far as we are concerned our payment was not contingent on them receiving this money from the apartment so they should pay our invoice as they agreed to 30 day terms. We are a general contractor working on a residential project. We just fired a subcontractor for failure to perform service to our agreed upon quality standard. The issues are well documented and have been continuous throughout the project. We paid them for all work done so far, but reduced the 3rd draw payment by the value of the labor and materials to repair some of their many mistakes, and docked them the field supervisor fees for the third draw of the contract as they had not actually supervised the field, resulting in many issues. The errors were significant and expensive. They have not signed a lien waiver. We realized walking away that we should have had them sign one before we paid them. We have never had to fire a sub before. We have an arbitration agreement in the contract....Read More

Last day of project was March 30, 2019. The roofer's attorney filed a claim of lien on Jan. 9, 2020 which is well after the 180 day deadline (which was in Sept. 2019) which makes the lien invalid. What can I do? I am still battling with insurance company for remaining amount for roof. I am the only one on the contract and he is suing both my husband and myself. My husband is not on the contract at all but is on the deed to the home....Read More

We are on a project in NC and the GC has lied about checks being sent, sent half payments on draws, never once paid on time, and now gone over 60 days. We finally placed a lien on the latest past due draw as well as the late fees due. They said that we have now held up payment for everyone because the lender will not release their funds. They bonded around it which is great given we worry they will run out of money. Now they want to make a partial payment on the bond (pay the draws but not the late fees) and have us sign a partial release of lien. I was under the impression they were not legal in NC and the only way to release the lien was to satisfy it entirely or convince me to cancel it. ...Read More
