I did work on this project and me and few people who worked there didn’t get paid. We found out that the owner is losing to the property to taxes in two weeks and I was wondering how I would get paid. Does the town who will own the property in two weeks pay me when the sell it or does the lien just transfer it the new owner who would buy the property from the town. ...Read More

So we paid off the lein to the county clerk and the subcontractor had one year to bring a law suit. The sub contractor never sued since he had no mean of winning. How do we get our 11,000 from the town clerk....Read More

Hello I worked on a construction project and the final payment was never remitted. it is 25 thousand and now over 40K with interest charges. Customer owner/was also the GC in the building -I provided door access and thermal monitors. The system has been running since 2018, when I went back to receive my final payment from finalizing the "punch list". I placed written final demand and The General attorney for the firm agreed I will be paid after the ;ist. When I arrived on site, there was a new General attorney and no one to pay me. The new Attorney made me go over all details again, said there was yet another punch list, agreed to my payment and then left. Why> Both attorneys were also Never Paid. The project was a NY State Building Brooklyn Army Terminal, and the GC was also the owner, of this compounding pharmacy. ...Read More

Dear Levelset Advisor: I have utilized your "notice of intent to lien" letter recently for a delinquent in payment client. I did not do any type of construction work at this client's home. What I do is appraise personal property to be sold, plus organize and conduct estate sales that are situated in clients' homes. This particular client chose to cancel her estate sale at the very last minute. My staff and I had already staged her home for the estate sale, displayed all of the household items that were being sold, researched resale market values and priced household merchandise, advertised the estate sale in several media venues, identified the fine jewelry to be sold and arranged for diamond rings to be appraised. The contractual agreement indicates that if the client cancels the sale, he/she are responsible to pay for services conducted and the amount is indicated in the contract. The client engaged my company on July 3, 2019 and then canceled the estate sale on July 30, 2019. I was notified by her son to send him the invoice, which I sent shortly thereafter. No payment was received. After a couple of weeks, I called and left a message, there was no response. Two weeks ago I sent another invoice with a friendly letter, again no response. I see that your services are geared to construction companies. Would my company fit in somehow or not? Thank you for your kind assistance. Sincerely,Cynthia Illicete-BurnsFull Circle Estate & Tag Sale Services LLC ...Read More

My company is a general contractor for a solar project being executed in New York. One of our subcontractors has sent us a mechanics lien notice for non-payment of sums that were never approved by us under change orders. We are looking to contest the lien claim for lack of substance, but aren't sure if we can write to the county where the site is located to stop recordation of the lien claim by providing a notice of contest along with proof, or we need to wait out until county takes any action on the lien notice delivered to them. Could someone please advise the recommended course of action to contest the mechanics lien for being unsubstantiated....Read More

I am the project manager for the property owner. We recently completed a project, and the General Contractor has been paid in full for the contract total and provided an unconditional lien waiver. However, one of their subcontractors reached out to me saying they had not been paid and that they were moving forward with filing a mechanic's lien against the property. Am I responsible for paying the subcontractor if the General Contractor did not fulfill their obligation? ...Read More

I have a general contractor whose retainage payment was delayed because they refused to provide the closeout documentation outlined in their construction contract (documents that are appropriate for this phase of the project, such as conditional waivers, progress photos and proof of inspections). We were in constant communication and advised them that as soon as their obligations were satisfied, payment would be released. In the end, we called our losses on a few documents just so that we could get them paid and get the project wrapped up. Shortly after we made final payment, we get a notice from the county that the contractor had filed a mechanic's lien against our property. I have made numerous attempts to contact the contractor to request they file a lien release, but they are ghosting me. If they will not voluntarily file a release, what are my next steps? ...Read More

We are a specialty supplier/manufacturer of stainless steel pools and spas, and for a handful of our projects we are responsible for their onsite installation. I was wondering if I should use the first timecard from engineering department to design the pools/spas for this project as the first furnishing? Or should I use the first date payment was received by the customer, which occurred a few months later?...Read More
