Regarding Class 4C apartments in New Jersey.
If the subject is a proposed development of say, 24 apartment units for rent with no retail at ground level, is the subject "residential" or "commercial" for lien purposes?
Notes: project still under construction. No CO. Prior class was 15D, religious (demolished).
New JerseyIm a fencing subtractor and finished a project back in September of 2021 and the company has not paid me as of yet.
I already did the Notice of Intent with you all and Nothing.
Also hired a lawyer who sent a letter and Nothing. Thousands of dollars paid to lawyer for nothing to happen.
What can I do next that wont cost more $$$ and get paid from this company. Frustrated!!!!
New JerseyWe are an Operations & Maintenance provider and the GC of the project wants to include the following clause in the contract, "Contractor shall not place any Lien or other encumbrance on the Facilities or the Sites."

New JerseyI recently sent out a Notice of Unpaid Balance in association with a residential construction lien in NJ - where we also have to file an Arbitration Demand Letter.
I noticed that the Arbitration Demand requires a "Number Book Page" to be included. Does this information come from the county clerk's office upon filing the Notice of Unpaid Balance? And do I have to wait for this book page number before filing the Arbitration Demand Letter?

New JerseyWe are a NY millwork company selling doors and mouldings, we have a customer in NJ that we delivered goods back in September 2021 and we haven't received payment, we still have custom doors, meaning doors that we usually don't stock we just ordered and assembled for them but we did not deliver yet. Can we still file a lien and still meet the NJ deadline of the "last day on the job" since we did work for them at our shop?

New JerseyGood afternoon. We're trying to find out if the mechanic's lien we're filing is residential or commercial in nature. The property is a residential structure that is owned by a bank/trust and managed by a property management company that rents the property out to tenants.

We are materials supplier on the project in NJ, and we want to file Lien. In our agreement with the client and on architectural set we have on file, we found owner name, but levelset scout research indicated other company as owner. What we should do in this situation? Can we include both companies on the Lien?

New JerseyCan a mechanics lien be filled for licensed remodel work (a renovated bathroom where the project is complete, for example) where a lending agreement is in place? In other words, where the homeowners agreed to a payment plan - can that loan be secured by a mechanics lien where the contractor was still paid in full and the lender receives scheduled monthly payments from the homeowner?

New JerseyI was contacted and then issued a PO by the Clifton Public Schools to replace the wall safety padding in School 17 which was damaged by storm Ida. This was an insurance claim filed with their carrier.
After the work was completed the school/principal is refusing to pay the PO complaining about they wanted a different type of wall pad, that didn't show the anchors etc. which was more costly and wasn't what was there originally.
Meanwhile, she wasn't the who hired me to do this job.

Have a good written detailed agreement, finished the job, emailed everything, they offered partial payment, I declined, offered to defer a little until permits release, but they have gone silent, so I think I should file a lien.- or a Notice first if necessary.
The project involved changing the 2nd floor office condo replacing it with two apartments
There is an existing occupied Dr. Office condo on the first floor. Its in Middlesex
Last date of service was Nov 13, 2021.

There was damage done to my home. A construction company had me sign a contract that allowed him to accept money directly from the Mortgage company. The company took 2 years to due the project and its still not done. In the middle of construction the Mortgage company issued a check with my name and the Contractor's name on it. The Contractor died. His company filed for Chapter 11.
What are my rights to get that check endorsed by the Bankruptcy Trustee and given to me to finish my house? It is my understanding that if there is a Mechanic's lien against the property that the money is NOT part of the bankruptcy estate and that the Trustee can simply endorse the check on behalf of the Construction company. What if there is not a mechanic's lien on the property? Does the check become part of the chapter 11 filing, and my insurance money is just mixed in with all of the other Chapter 11 unsecured creditors? Can I at least be given Priority status as a creditor? This is taking place in NJ Bankruptcy Court under chapter 11 . Can I file against his bond company? I read that I might be able to give a 30 day notice to the Construction company to force them to file a mechanics lien, is that true?
Any information would be very helpful.
