What happens if we file a preliminary notice halfway through the project? For example, we sign a new sales order this week, but we have been working on it for the past six months. What right do we have in that circumstance?

MontanaHello - I hired a handyman to build a deck for me on my property. He made many mistakes that I kept having to identify and have him fix performing very poor work, and over inflated his labor charges. He could have also over charged me for materials as I never saw those bill and things would need returned and he claimed he didn't charge me, but I would never really know. He never put down how many hours he worked on his weekly bills just a large lump sum of money. I started questioning it on his last bill after many mistakes were made and the bill was getting out of budget. So I made him report on his hours and what he was actually doing. His last bill was way out of line and I was over charged. He did not have an explanation for it and I did refused to pay that labor in full as it wasn't accurate. He has now been threatening me in many ways, one of which is to file a lien on my house starting now. He never had a contract or anything in writing. He also convinced me I didn't need to get a city permit.
Does he have any ground to stand on and what can I do to protect myself and my hard earned investment?

MontanaI am at the end of an expensive house remodel. The GC has not made the last payment, we have no written contract, he is now claiming I made mistakes and has to hire someone to fix them. All work was done at his direction. My supply house has lien rights for the materials, the last payment is to pay them. There is no written contract between us. This money is from 2019.

MontanaWe needed to clarify whether the amount of the contract that we put on the preliminary notice is a binding amount, or whether it is just an estimate and the lien (if any needed to be filed) would be on the amount of the invoices in question.

MontanaI am looking through guidelines for Montana, and they all state a Notice of Right to Claim a Lien must be filed within 20 days of the first date labor/materials are provided. We will be starting a job on February 3, but I want to file the NORTCL as soon as I can. Am I able to go ahead and order this or would it be rejected if I chose to file the NORTCL prior to February 3 when the job begins?

MontanaA local business hired a main contractor to do a remodel who then subbed it out to another guy who then had my boyfriend finish the job as his "employee", as my bf doesn't have his own licence yet. I know for a fact that the main contractor was paid in full for the job and supposedly still hasn't paid the subcontractor that hired my boyfriend so therefore my boyfriend hasn't been paid and the verbal agreement was for about seven Grand. We're not sure how or who needs to go about doing what to get paid

We own our Plumbing and Heating co. Of course we work with a lot contractors and do service work.
There seems to be a lot of frustration in the construction realm that people do not have to pay us. So are only choices is intent to lean. Where is the laws protecting us. We do large and small projects. Thanks
