I hired a contractor to do work on my home. He never provided me with a contract - just an unsigned "Scope of Work" document listing the work to be done with one grand total at the bottom. I paid him a little over 1/2 of the grand total at the beginning of the project. We have now had a falling out, and he has refused to complete the project. He is now demanding the final payment minus some credits for the work that remains. The problem is he and I disagree on the scope and cost of the remaining work, and he is threatening to place a lien on my home. What are my options if he does put a lien on my home? Do I have any options to dispute the lien? Can I fight the lien? Can he place a lien on my home with a signed contract?...Read More

So my brother-in-law was in a contract for deed or so I am told agreement on a house here in Republic Missouri. My mother decides to build a Barndominium. You know just a small little barn dominion in this cool old barn that Amanda and Kevin, which is my sister her boyfriend, fiancé, . So with that being said, I am told that they get to purchase the house from Bryon the owner, which Kevin had flown out there and met with him about purchasing this house. Kevin found it in the first place. Brian was looking for some property to invest in in the agreement I was told was two years rent and then he could purchase it, he just wants to make 12 or 15% on his money I don’t remember which it was I believe it was 15% . So time goes on I’m building this barn dominion you know a couple years ago by and so like you know what’s going on Amanda and Kevin has split. It’s just me and Kevin living out on the farm so we talk about just going ahead and purchasing it between the two of us. And I was told by Gil Brian‘s mount know how if they’re related or not but that Brian would sell it only to Kevin point-blank. And then you fast forward and here we are you know we’ve got 50 to 60,000 and hard money and I have every bit of labor which is easily doubled that that’s how I came up with $120,000 that I am trying to place a lien for because he knew the work was going on. He knew what we were doing yet. Then he decided that he wanted to up the price he didn’t want to sell it. He may be even wanted to put some money in it. Two weeks later he is mad and trying to kick us out and having lawyers serve paperwork to Kevin and everything and it’s just crazy like I have no idea what happened or what changed but the place looked immaculate compared to what I ever did before I promise you it was an absolute shit hole. We literally spent weeks emptying dumpster after dumpster how they’re still at one big pile out there still can get today but you know we had to eventually stop working because we didn’t know what was going on why invest money into something that’s not going to be yours ?...Read More

Construction was done on a commercial property, company that we sub trough is filling bankruptcy and complete construction went un paid till date. A second company purchase all assets from GC we contract and they tried to buy all pending PO pennies on the dollar we counter but was decline as they are negotiating. At this point we would like to lien the property for work that was done as we have time and money invested but I'm getting a notice in level set that need to file a (Notice of intent to lien) but level set cant do it, any info how to move forward will be highly appreciate it....Read More

I am senior citizen with low income. I live in Missouri and I was approved for a grant thru USDA Rural Development to have new siding put on my house. Supposedly the contractor USDA chose did not estimate everything that I wanted covered with siding so I asked the contractor how much extra it would cost. He said $350 so I told him to do it and I paid him $350. Now he claims I still owe him money even though USDA paid him for the job and I paid him for the additional work. He has threatened to put a mechanics lien against me. He first said I owe him approximately $500 more and then second he said I owe him approximately $700 and he wants me to pay him by March 15, 2023. I don't think I owe him any money. I don't have any contract for the additional work other than a text message from him and me to him confirming the amount of $350. He did not give me a lien waiver. I'm a general contractor who provides tree services to my customers. I was contracted by the occupant/owner (at least he said he owned the property and residence) of a residence located in St. Louis county, MO. After completing 90% of the job the occupant/owner sent a text message telling me not to come back and that he had moved the Bobcat I had rented to complete his job from his backyard out into the street in front of his residence and that I had better hurry if I wanted to retrieve said property. He also kept my climbing rope and carabineer as I had left them on the base of the tree I was planning on dropping that day (the day he sent the text telling me not to come back). He knew going into the job that it was a $3,500 contract of which he paid $200 cash on day 2 of the job. The day he said not to return would have been day 4 (and the final day) of the job. He will not acknowledge any invoices and ignores all attempts to call/speak with him. Since he refuses to communicate I began the process of putting a lien on his property during which I discovered he is not the owner of the property, his sister is. I am unsure how this effects my right to file a lien. So, can I put a lien on the property despite the fact that my contract was with the occupant, not the owner? And if I can, what do I need to do and how do I do it? If I can't put a lien on the property since the contract was made with the occupant not the owner what recourse do I have? I won an eviction case and wrote out my rent check. After doing so i realized that i forgot to prorate on the first month l lived there so i wrote a letter to my landlord showing where i prorated and wrote a new check i wrote in the memo paid in full through oct 2022 and also ask my landlord to give me back the other check that wad the wrong amount and not prorated. She cashed tbe prorated check but refuses to give me back the other check and keeps trying to cash it (ive been kerping my account low enough where it wont go through) now she is taking me to court saying i owe alot more than just the rest of amount from the prorated check. We are a boyfriend/girlfriend contractor team who were hired to do a total home renovation and remodel in the state of Missouri by an individual owner. The owner did not draw up a contract and said they preferred a verbal agreement. Per the agreement, for compensation of the remodel, we were to be provided free housing and utilities on site the property we are working on with the promise of a rental property owned by the same person upon completion as well as daily compensation for food/materials/living expenses and the fulfillment of a paid invoice for the services completed. We have worked and lived on sight since July 9, 2023 and do receive mail at said residence. Payments have been spotted and sometimes completely withheld forcing us to aquire loans which are now unpaid. As well, the homeowner began entering our dwelling without notice or permission, rummaging through our personal items, and taking a very unhealthy interest in, especially the male figure in our equation, personal life and private affairs. Homeowner also began dictating how the earned wages should be spent opting to take us grocery shopping rather than paying us via cash, check, etc. After Homeowner became so engrossed in private affairs that she brought the male worker suppositories and demanded he gain a divorce in order to obtain the promised rental property upon completion of this job, the female in said partnership had a discussion with homeowner regarding professionalism and sat healthy and fair boundaries asking the homeowner to respect. Since this has taken place, the homeowner has stated "she doesn't like her anymore" and has attempted to retain the male both as a worker and resident in the home while kicking out the female without just cause or notice. The homeowner is refusing to pay the male until he gets rid of his female business associate and live-in girlfriend. Homeowner has even gone to the extent of contacting the ex boyfriend of the female, whom the female was a victim of abuse in said relationship, which was known to homeowner via intrusion of personal affairs, and allowed said third party to enter into the dwelling without supervision. Homeowner also gave third party access to the vehicle that was jointly owned by female and her ex to the ex boyfriend leaving female without transportation while demanding she be thrown out of property. It is winter and cold and with no source of compensation and no other forms of income, no transportation now, and no place to go due to not having relatives in Springfield area. Homeowner has not paid either party in 3 days leaving us without food or the ability to get any other needed resources. Homeowner is refusing compensation until demands that female,without just cause, be removed from property. Invoice for the cost of work completed up to this point have been furnished to the homeowner with refusal to pay. What can we do? It's cold outside and we fear being made homeless by this woman. She also sold the property promised to us upon completion of this project. As well, she bought a trailer and put it in the backyard of property where we work/live with a homeless man she just met occupying it to keep tabs on our coming/going. She has illegally connected shared power to this trailer and is now attempting to make us not only cover our own utility payment, but also that of the man she moved in. Person is suspected to be a drug user and does not have employment but receives shelter and money from homeowner. We are desperate to gain some insight as to our rights legally in this matter. She has been a constant source of harassment via telephone and in person visits on nearly a daily basis, screaming matches, slandering and falsely accusing female of things both professionally and privately, has threatened to call the cops on said female, and do whatever is necessary to make her life a "living hell" all the while encouraging male to join their alliance and break off all contact with female counterpart. We are a subcontractor to a company on a commercial construction project. We have had issues getting paid by them before. The Pay Application we submitted over 30 days ago has not been paid. They say they have not been paid by the owner. I requested to know when they submitted their pay application to the owner, they have not answered that question. I am in Missouri. Their contract says that we will get paid when they get paid basically. I want to and have the right to know, by their contract, when they sent the pay app and when they get paid.
