I own a design+build firm where we help clients design a custom home and subsequently build that newly designed home. I'm also a licensed general contractor in Minnesota. I currently have a have a client who contracted my firm to design a new luxury single family home for their family, and this client currently has a $23,300 outstanding invoice with my firm for architect services, interior design services, civil engineering, and structural engineering design, but they are refusing to pay this final invoice. The civil engineer/surveyor is a subcontractor of mine, and he did some on-site work during the design process, including staking on the empty lot to complete a updated certificate of survey. Other than that civil engineering work, no other labor, demo, excavating or construction has been done yet on the client's empty lot they own. However, we did substantial design work and completed the design for the client, and they simply got cold feet at the end, even after we went through multiple redesigns to get within their set budget. My firm completed all the work outlined in our contract and should be paid for the work we did. The client owns the empty lot and signed our Design Services Contract that includes a Pre-Lien Notice with my firm after they purchased the lot. The client now has their lot under contract with another buyer for a higher purchase price that they purchased it for ($280k higher so they are making a considerable amount of profit), and the sale is set to close to the new buyer on Sept 30th. I would like to file a lien on the client's lot for the outstanding $23k+ invoice before they sell it, but I have been hearing some conflicting opinions that I may not be able to file a lien for the Design Services work we've done. I have received a partial payment from a property own. His son initially reached out to my company and set up the job. All documents required by MN were sent by the deadline(s). It was an emergency after a storm with an insurance payment. We were short payed by 30%. All attempts to settle were made prior to the mechanic's lien being filed. I was hired by the homeowner to be the general contractor. I then was asked If work was available by an individual... so he worked under me for 2.5 weeks. Week 1 his hours worked and time on jobsite were very confusing....but managed to get through it . Week 2 the individual submitted 20 hours at end of the week. As the general contractor I disagreed with his hours cause I knew there wasnt 20hours of work for the week.
So after going over hours with the worker we came up with 8 hours actually worked. Worker was told of tasks he was allowed to do. And at the end of the week worker said his tasks were all done. By the weekend when I went to check work completed I found the work was not completed. And other tasks that were not mentioned were completed... sorta worker applied shingles to an area with out proper code materials.now more materials will need to be bought, and time to tear off and proper materials layied down then time to re shingle.... a cost that was avoidable. Now worker wants his money and is threatening to put a lien on property....Read More
I hired a general contractor in late Sept and my project (job) started in Oct. I have made several payments to the general contractor as the job progressed for all the sub contractors work and he has not paid the sub contractors. I have been in conversation with the electrical sub contractor and he wants to put a lien on my property to light a fire under the general contractor. I understand what the lien means for me as the property owner but can not find info on what that means for the general contractor....(My contractor stopped communicating with me and will not answer me for the past 4 weeks.....his work has been less then professional and my contracted job is not complete with zero communication.
