Hi, what must my town do to pull a bond on a housing development that has not been completed by the builder? Builder just needs to finish road and punch list items but has been ignoring town. I am on a private job in ma for subcontract work that I was not paid for 220k of work completed. The total project worth is 20M. I was informed there is no bonding on the job. This is NOT public or state work. One would think that the laws would require the construction company to have bonding but I have been reading that only public jobs require this over 25 K. I know procedures are mediation and arbitration but is there anything else I can do besides liens? Thankyou...Read More

Sirs : With the Aid of your firm I placed a lein for $19, 332 on a Sub contractor working under a large GC for a Large State Of Mass Project( Massport) after 6 months on discussions back and forth _ the Sub makes not attempt to pay the debt left behind. I have a Copy of the Bonding company that bonded the project the sub was working on.Do I have any bond claiming rights for payment under the Primes bonding company , even thought we worked for his Sub. My company is a material supplier. There was a disagreement over the intent of the drawings, approved submittals, and the job site conditions had changed. They expected our firm to make field modifications to the door frames at no additional cost. We had an approved submittal stating what size the frames were to be. We made the modifications, and they back charged our firm for the amount of additional labor required by their firm to install the frames and hardware. We were only a material supplier. We finally agreed after six months to accept a back charge to a least get part of our retainer returned to us. We signed the change order to allow the final retainer to be paid. After the agreement it has been sixty days and we still have not seen the retainer....Read More
