I have a client that is refusing to pay the last of the $1,000 she owes my painting and remodeling company. We had a contract, although I'm not 100% sure I can locate the signed version. We have several email communications however and very clear proof of the job/work done. Her son, also included in communications is the actual property owner. In any case, we also did $2000 worth of extras for her. We submitted an invoice, which she initially agreed to pay, and is now refusing. I am curious if I can ask for the entire $3,000 in the lien, or just the $1,000 from the contract. I am also wondering if this should be sent to her, or her son who is the property owner. They both live in the home. Right now I am trying to settle this without further action, but I have yet to hear back. Also, will I need to get a lawyer for this at some point or can this all be done by myself and levelset? ...Read More

mechanics lien has beed put on house work is subpar wood floors are cupping, kitchen cabinets doors are not lined up, ceiling moulding are mot flush to ceiling, mittered corners have large gaps and not straight new front door was not installed master bathroom shower not done paint is chipping and patched up plaster board can be seen did not put step on front main door paint on new installed windows interior vinyl clappord on side of house wavy (house was completely resided) crawl space barrier disturbed and has plenty of ground showing ( in perfect condition prior to floor work wood floors have dipps and not level to each other on same floor joists were replaced and additions floors are not evenely matched up not sure if moisture barrier was installed under wooden floor between hardwood and sub floor electrical is not complete put tankless water heater in incorrect spot refused to move it have asked several times for accounting on work never received plus some other issues what is course of acction with the lein?...Read More

I am a home owner who paid an hourly laborer in full for all hours worked then told him I have no more work for him. His work was very shoddy, he padded his hours, took 5 smoke breaks an hour, was very pushy and even started to work on things I did not hire him to do. There is work to be completed, but due to budget I will be completing myself. And fixing all his screw ups. I paid him in full for all the hours he "worked". I do not have the money to pay him to do the rest of the work. So basically he has been laid off. He's now threatening a mechanic's lien. Can he do that?...Read More

I was hired to provide consulting services which we agreed on a rate per month. I began the engagement and received my first payment about 60 days into it. I continued to work for another few months with no payment. I repeatedly asked for payment and finally stopped working due to non-payment. I hired a collection agency about a month after my last interaction with the contractor. It has been almost a year since I last worked for them. Tenant wanted to do upgrades in apartment. Homeowner said that was fine with him as long as tenant paid for the upgrades. work was done in two parts. Part A was compleated and paid for. Part B was compleated and tenant refused to pay stating "I am not going to pay you because i have spent the money on something else".
