Do we have to be registered to do business in the state to file a lien in that state? For example, we may do one small job in Montana where we might not actually be required to be registered in that state due to being under revenue requirements, don't have actual personnel living there, etc. Would we have to be registered in order to file the lien?
MontanaWe have a contract to install underground irrigation on a multi-use building. The contracting company is not operating at full steam any longer, they are reorganizing or selling or closing (???). We received a letter promising that they would make small payments on the remaining contract value but they haven't even done that successfully. We filed a lien but heard the property sold 2 days earlier. Any suggestions?
MontanaMy husband subcontracted a job and was delayed in getting the project done due to material that didn't match etc. Once proper material was acquired the job was finished. The homeowner didn't have any complaints as the job was being done, to begin with but now when it comes time to pay, he is making several complaints to to the general, but the general has not provided a list of repairs to be made. He has not yet paid my husband for the work done, and is trying to call a small 800.00 payment and now a 1500.00 payment as payment in full. The full job should be in excess of 3875.00 for siding alone and more for the fascia and soffit. What can be done to get paid what is owed to us?

MontanaWe are a general contractor located in Pennsylvania and did a project in Great Falls, MT. One of our subs filed a construction lien which we feel is incorrect. He is not owed the amount that he is claiming. We do owe him about half of what he is claiming but he would not sign and notarize the waivers required for payment.

MontanaThe guy never ever mentioned that we had to pay for garage door on garage he was bldg. For us. Why would we contract w him for a garage w/o a door
MontanaThis project has a bond, which our customer paid everything under the bond to the fund control except for $1000.00. We also billed this customer for a separate order related to this project as well. The fund control has now sent this money to the bond & now Hudson Surety has the funds that our customer paid to the fund control and has had these funds for a month or longer and is stating that they need a letter from our customer stating that they are done with the bond. We paid for the bond, but yet it is working against us. I am not familiar with this process as we have never done a bond on a project before. I am hoping you can give me some insight on what legally we need to do to get paid the money that the bond is holding and plus what is owed additional on this project that is not part of the bond. Project is in the State of Montana & we are in State of California
MontanaHello, we completed a few projects in the state of Montana (labor & material) in April/May of 2017. However, we have been replacing some of the components and have provided additional labor and material to the customer since that time. At what point what the lien deadline start? I understand we have 90 days to file from last material shipped/labor provided, but we aren't charging for the material/labor from late 2017/early 2018. We want to be able to place liens on these projects.
