I built a deck for a woman in Montana. She refused to pay me for additional work she requested, labor and material. She is an angry, condescending, verbally abusive person. She has lectured me, screamed at me, insulted and hurled f bombs every day. She tried to bully inspectors and knows more than everyone. I was ready to let the loss go, not worth the trouble. The job passed inspection 15 days ago. She is sending me angry emails and has accused me or emoyees of stealing a tool. She is demanding $190.00 and is threatening a police report. I was framing a house for a contractor and Big Sky the concrete for the job was supposed to be done in May and was not completed until December and still not 100% completed the contractor refused to let me go do another job so that I can stay fed pretty much can I file a lien on the property in the state of Montana without filing a preliminary notice or can I still file the preliminary notice now he kicked me off the job on December 15 for not being there but he had the excavators tearing up the whole job site and multiple guys were injured from climbing over the mounds of dirt and alsoWe’re unable to work due to Covid that we believe they got from the architects secretary who was tested positive for Covid and came to our job site, several times I was asked to drive up to the job site which is an hour and a half drive to unload materials majority of the time they were not even for framing and I am the framing contractor also I had put in 178 man hours with my lift and my guys assisting the concrete guys and I was asked to do so by the contractor and they refused to pay me for it all the materials for the job have never been there And all the take offs for materials were not there or incomplete also his secretary coming to the job site knowingly positive for Covid and while doing so one of my workers had also gotten Covid recently after and his major complaint was that guys were not on site and the reasoning is because of Covid and because he had our job site torn apart by the excavators and multiple times have my guys been injured trying to work over and around the excavators this job was supposed to be a summer job early summer and it wasBid for that end it is now the middle of winter and concrete has just barely been finished and I have lost all my major contracts because of this and the months that I make all my money what are all my things that I can make the bond amount for on this lein...Read More

My roofing contractor cashed my check for more than half of the job on July 23. It is now December 4, and I am trying to get him to finish the final details. The job is full of mistakes, damage, and broken promises. The contractor approached me with a bill for almost $4,000 more than the original contract I signed. It is for stuff that should be inclusive, like drip edge, valley metal, and demolition. He has threatened me with a lien and sprayed me with gravel from his truck and cussed at me. Can he put a lien on my property for more than the signed contract and before the job is finished? I wrote him a letter three weeks ago asking him to finish the job so that I may pay him. Had someone that was supposed to core some holes on a property. He arrived said we didn't give him accurate information so he didn't bring the correct equipment and then he left never to return. He is not filing an intent to file a lien for the full amount he quoted without performing any work. We completed a residential project in July 2020. It did take us longer than expected. We submitted a final invoice and the homeowner refuses to pay. So we started the lien process against his home. Naturally, him and his lawyer are nit picking at everything. Some of it my recordkeeping and filing abilities or lack of. IIf I have a project that is split into 3. For example, siding, new roof, and repairing the driveway. Is it insurance fraud if I raise the price on one of those three to help pay for the other? I had a plumber fix a leak at my rental property in Hamilton. It took 7 trips for him to fix the leak, starting in April and finishing in June. I received my first bill August 1st. The bill is for $2309.71 for a shower leak. I have made multiple calls and was told I can make payments. I said I can do $200 a month. Apparently that is not enough for them and unless I pay in full by tomorrow I can sign a personal loan to the companies accountant at 12% interest and sign over my house as collateral, or they will place a lien against the property. My questions are can they place a lien if I am making payments, and if they place a lien can they force a sale of the property if I am making payments on the bill?...Read More

1. Do we legally need to file a preliminary notice, to file an Intent to Lien, prior to filing a lien on a property? 2. What right do we have to lien a property without filing a Preliminary Notice? 4. How long are preliminary notices valid for? We found some information that indicated that the preliminary notices are only valid for one year, and that a continuation notice needed to be filed. 5.
