I have a Contractor in my current project. There was no contract provided by the Owner, only Notice To Proceed. Now the pending billings which was submitted last were being re-evaluated by the current Management. Findings were all quantities are not evaluated properly due to incomplete plans and specifications during that time. Is there a legal concern if the quantities and unit rates that were approved before will not be honored today based on the evaluation? Thanks....Read More

We are a small Minority contractor, fabricating steel exterior stairs for multi-family housing units. We currently in a discussion on what constitutes. We delivered fabricated steel to the prime contractor (also will own the property once finished. Once this product was fabricated it was delivered to the Job site, to be painted before erection on the building. After delivery and before painting, the material was stolen from the job site. We asked the contractor to replace the stolen steel. since it was stolen from his job site. The contractor's position is that it does not become his property un till it is installed. Hi guys! I am studying for my architectural license exams (the AREs) and I had a question come up that I missed but THOUGHT I got right. Basically, the scenario is: the architect goes out to a site visit and finds some bollards missing on site. When asked, the contractor replies that the bollards were not shown in all architectural drawings, only in the landscape drawings & specifications, therefore, the contractor only ordered what was shown in all architectural drawings. (let's say for example there are 8 bollards shown on landscape and the contractor only ordered 5 because that was shown on the architectural plan & sections). Per the AIA A201, who is responsible for paying for the other 3 bollards? I answered that the owner still has to pay for the bollards, but I got this wrong and the people creating the content told me this was in the A201 that the contractor would have to pay since they missed it in the bid. However, this does not make sense to me because the owner would have paid for the 3 bollards anyways. I also asked a contractor and he said I was correct. I was hoping to get a contractor's perspective on this question and hoping you could point me to the right place in the A201 where this could be answered? The answer description from the question creator was that "A201 states that all drawings are complimentary therefore, the contractor has to pay for what he missed" but that's not what the contract says exactly. It says "all drawings are complimentary and the contractor needs to familiarize himself with the construction drawings and point out any discrepancies to the architect" HELPPPPP!!! My uncle filed a mechanic's lien against my mother's property 3 days after she passed in order to secure an interest in the property. There was no notice of intent, no invoice with signature, no work performed by my uncle. My mother did contract other Arkansas contractors for work and they were promptly paid. Uncle performed work as GC and was paid. Mother died on Jan 3. Jan 6, uncle files mechanic lien for same work claiming non-payment. I have checks and the pictures of the work completed 12-28. Uncle forwards mail from deceased sister to his house. Jan 20 uncle transfer utilities from property to his home. Hi, my contractor has made multiple mistakes while constructing my house and many of these still are not corrected. I have been paying biweekly draw and down and nearing the end of construction. I really feel that a portion of should be retained until he corrects some major problems. What rights do I have to retain some payment or do I need a lawyer?
