Hello, I am a truck driver for a company based out of Chicago. I am a Kentucky resident. I have hauled many loads over a couple of weeks and have yet to be paid. They give me numerous excuses as to why this hasn't happened. I do have possession of their truck and trailer however, the same equipment that is used to perform my job. Can you tell me if it is possible to put a lien on this equipment until I am paid? What is the procedure please. Greenup county KY. Thank you....Read More

I am a subcontractor. The project we are working on has run several months past the original completion date, for various reasons, none of which have anything to do with our company. The GC keeps giving me the hours are hours speech and not recognizing I have additional costs related to these project delays. Instead of 20 guys working we only have 5, but have other costs involved. Including: Multiple rental equipment, fuel, overhead and housing. We sent a preliminary notice for a public job in Kentucky and Boone county recorded the document as a lien. Which is in turn causing the owner of the project, the City of Florence to withhold payment. According to the Boone county recorder this is how they "file" the prelim it is actually processed as a lien so our only way to "release the prelim" is to release the lien. In the future I am trying to make sure that we have coverage for our projects in Kentucky. How should a prelim be handled ? Who should it be sent to ? Does it have to be filed with the courthouse because they are not treating them as a prelim but are treating it as a lien. ...Read More

We have a customer that is requesting we "release" the prelim we send back in July of 2019. We sent a retraction letter already but I do not see an option to send a release for a prelim. To my knowledge those only had to be sent for mechanics liens. If I am correct can I be provided with the legal wording that says as much so I may provide it to my customer. ...Read More

I have an LLC in MO and contracted with a large General Contractor also in Missouri to complete a half done project in Louisville, KY. The owner of the Louisville property pre-funded my payroll and materials with cash which was to be paid back as my invoives were paid through the monthly draw process. As the project continued the draws DID NOT process due to the owner not processing them. Therefor I have not paid back the cash advances OR been paid any profits. My time is very shortly running out to file a lien against the property and I'm concerned I could eventually be held responsible to pay back the advances without receiving payment for the invoices from the General Contractor. I signed an agreement upon receiving the cash advances SPECIFICALLY stating the advances to be paid back from the draw received from the General Contractor. My profit at this point represents about $14K. The outstanding invoices total approx. $614K. The cash advances total approx. $600K....I provided labor and materials and my last day on site was 3/24/17. It appears I may be entitled to ask for interest?...Read More
