A property lien was paid in full in June 2020. I live in Hawaii. It was only after I tried to refi my house for a lower interest rate did I learn that (2) of the liens were not processed and the company did not file a satisfaction of these liens until last week....is it true that I can get damages in the amount of $1,500 for each lien that was not processed...due to the company not releasing the liens it caused me many many delays in my refinancing process and I almost could not close in the refi.......Read More

Estimate given ESTIMATE OK'd Nothing signed. No proposal or Quote Given Cash installment paid Job starts Customers visit shop 3 times. All seems ok Cabinets transported to residence. Cabinets install begins roughly 10 days to complete install. Install included extra trims and panels not included in estimate. install complete invoice given. no Payment. Invoice given again. no payment. Third invoice given with verbal conversation with owner flipping out with verbal abuse towards contractor. Refusal to pay balance of job. Total estimate 13,500.00 cash payment of $6000.00 given to start. BAL.$7,500.00 Extras addition to estimate during install totaling $1500.00. New balance due $9000.00 Materials receipts totaling 10,000.00 +/- request payment. No payment. customer wanted shoe drawers to be redone. (shoes dont fit) 90% of shoes fit. ankle boots and such no. They were not visible when I was originally measuring shoes. Client were standing there with me witnessing me measure multiple shoes for accurate construction of drawers. I refused to redo drawers after being verbally abused by client. So I reduced balance due $2000.00. Making balance due $8000.00. Client refused to pay anything until drawers were fixed. 2K is more than enough for 16 drawers which were to be made into 8 drawers. I had to pay for all materials to complete job. i LITERALLY made 0 money on project. In which I designed drew up met 3 times before begining project. Lockable Jewelry (hidden) was originally considered a safe with shelves and something to hang necklaces on. It morphed into being lined with black velvet and much more. (Not written on ESTIMATE) Also gun cabinet (HI DDEN) NOT written on estimate. Client says those were included in the estimate. Client claims that cash down payment turned ESTIMATE into A LEGAL DOCUMENT. NO RECIEPT Given for cash payment. What If anything can I due. No license on job. No permits. Basically a gentlemen's agreement as far as I was concerned. Client claims estimate was a legal contract. I say an ESTIMATE is just what it is " AN ESTIMATE" Not a Quote OR A PROPOSAL. Do I have ANY recourse here. The more I write letters to them the pissed I get and write statements that will not help my cause. I asked why didn't you say something when you came to my shop 3 times. Why did you let me spend all that time installing and never mention anything about ANYTHING. PLease help me. I have had to give up on it just so It wouldn't keep renting space in my head. Are "emergency plumbing services" included in the laws for Hawaii Mechanics Lien which limits them to put a lien on my property to within 45 days of completing the work? The company damaged my property while working on my home so I said I won't pay them until they fix it to which they agreed but communication stopped. They contacted me 6 months later saying they didn't agree to fix the damage and that I still owe them money for the invoice or else they will put a lien on my property. I emailed them with proof that their manager left a voice message promising me that they will fix the damage. They haven't responded for another 2 months since. Hi, I have an unlicensed contractor in Oahu, Hawaii saying he filed a mechanic’s lien on my property yesterday. Long story short, this contractor was a no show half the time. Never signed any contracts and penalties but received them. He is saying I honored his terms by working with him and making payments, and that his contract stated no liquid damages. But does this also mean he is honoring my independent contractor terms which state that he will pay a penalty of $150 per day for every day after the deadline if we’re now going on verbal honoring since there is no signed contract by both parties? I made two payments to them. On the second payment, they signed a conditional lien waiver. After second payment, they practically stopped showing up entirely. I had them rip out the bad tiling job they did in the master shower after second payment. There are multiple instances of poor workmanship throughout the home which I’ll be paying the new contractor to repair. The project is now over 3 months past deadline, Aug 17, as stated on the initial contract. I finally got another contractor in to finish up, after documenting and taking what pictures I could of the current state. It took a month to find someone to finish for at least the same amount that was left with the unlicensed contractor, but that is because I know this contractor and I was able to negotiate him down from what he originally wanted, which was more than what was left with unlicensed. In fact, all the contractors who bid to finish the work wanted about 10k or more over what was left to finish. A few weeks ago I decided to finalize my parting with unlicensed contractor (because they were showing up to the site saying they wanted to get their stuff) by sending them a final unconditional lien waiver. A week later they asked for $5,700 to sign it. And then sent me a new contract, labeled “invoice,” which is 11k over what was left to pay them. Little over a week ago they threatened to file a lien if I don’t pay. Now they’re saying they filed the lien with their lawyer yesterday. I confirmed with RICOH that their license expired Sep 30. The unlicensed contractor is saying that his license is inactive due to the fault of the DCCA not recording his new insurance but all that is remedied and not yet reflected in the online system. I’m not seeking anything from these guys. Not only was this contractor not showing up. They were smoking on site and left enough of a mess that the neighbors called to complain about it. My independent contractor form specifies professional conduct and acceptably clean work site at the end of the day. They also purchased materials for the job after I told them not to because I had a suspicion they were doing so just to keep the job with us alive somehow. The contractor claimed I restricted them access to their tools and materials because I changed the lockbox code. I did so mostly because I told them I wasn’t working with them anymore. But also because one of their employees, the one guy who was coming to the house by himself from time to time, told me they were having personnel issues and let go of some people for stealing money. The second payment I made to them was in October, for which they signed a conditional lien waiver. Soon after seeing the quality of work and having them confirm and remove the master bath shower tile, which I purchased but they were supposed to, I intended to move on from them. And figuring I would never get the deadline penalty monies credited by them, I decided to just send them an unconditional lien waiver to finalize the separation.
