We have completed our contract amount of 191,513.95 on a home damaged in Hurricane Michael The homeowner received 288,000.00 from insurance. The final inspection passed three weeks ago and the man assures us that the bank said the final funds of 78,000.00 of which 18,000 is to pay the public adjuster. will be available this week however he is indebted to us $125,198.00 and has not made a payment since September. Is there a form/contract that we can have him sign promising to pay the remaining amount due for materials and services performed?? Under contract, my Contractor has failed to complete the job not only in a timely manner, but at all. He told me it would be completed by last Thanksgiving, 2021. Any correspondence results in a 2-3 week lapse in any further responses, always initiated by myself. Now my Homeowners Insurance is threatening to cancel for incomplete work. Hello, I need your help. One of my suppliers forgot to bill me $60k for materials delivered on to my job 5 months ago. They said it was an oversight. They decided to add the old invoices now 5 months later. They had already provided me with Unconditional waivers month after month which means I dont owe them for anything, especially 5 month old materials. I would pay them but covid has really hurt us and we also dont have the money. The biggest issue I have now is that my contractor will not pay me until I provide them with the new unconditional waiver that the supplier does not want to provide because of the new invoices. If I dont get paid, I cant go on and pay for payroll. I am planning on walking off the job but now I am concerned the contractor wont pay me my retainer of $250k. The contract doesnt state anything about a right to stop work provision. I also know this may cause collateral damage. What do you recommend I do? We terminated contract with GC's rep that is using GC license, due to terrible workmanship & found out that he has not paid subs for work. Initially this person said his partner, Judson Bentley held the GC license, well that is BS and he just uses the GC license. This person now has 90% of money-at least 50%of job left to complete. He is non-licensed contractor in general who voluntarily closed his corporation with the State of Florida during the job, he still cashed checks from us. He obviously did not pay taxes on this money. When we found this out, he signed a personal responsibility note for us, we then wrote checks to him personally since we were not comfortable writing checks to a Name that did not exist any longer. We asked every time we wrote a check, did you get a corporate name yet? Not yet, blamed the State for the delay. He forged my spouse's name on Permit Docs with the City, he demanded $ from us weekly to keep the job going and we have saved voice mails of proof, on May 12th, he left the job due to questions from us, the homeowners, about the workmanship when we had called the product manufacturer for input of what he used on floors, they arrived May 12th, tested, determined not used properly by non-licensed person and that the tile in the bathrooms needed removed as well. Instead of using subs, he did the floating of the floors and the tile in the showers, when we questioned the work, he said he has done tile and flooring for 30+years. He blamed the flooring product, blamed the tile we picked for the tile shotty job. We need to now jack hammer the second time, the crap he used improperly on the floors, tear out the showers due to the way he did the tile job & need to find a new GC to finish job. We since found out that he did not pay the subcontractors such as drywall, electrician, cabinet guy. We have contacted 3 of them to offer the opportunity to finish the job, offering to pay them for non-payment from this jack- - -, they have been contacted by him and now not responding to us. He did Not have Workman's Comp on workers he had on job, the General Liability Insurance is in the GC's name that he uses, and the insurance company is not giving me any info to verify the Dec page provided to the Condo Association. This guy will not release our Doors, Hardware, Primer, Paint, Quartz Countertops, Baseboards, and the guy that has fabricated our cabinets for kitchen and baths has not given a price of what is due to him, + other items we paid him for. He brought in a water heater that has a warranty card from 2016, when we asked for the receipt he could not provide one. We have a Notice of Commencement, there are at this time no leins against us or our property. The City permits under the GC end June 20th I believe. He now is very anxious for us to sign a "Hold of the Permits", which I see no rush to do for his convenience. What if anything can be done with this bad situation about this guy and am I allowed to put this info online to the public with pics of the work?...Read More

I am Homeowner, Received claims money from Pipe Law suite, I used the plumbing contractor the lawyer used. They did half the work, left me with the use of one toilet and kitchen sink for two months, In their contract it stated they would pour back the cement floors, then they said they will not and they could not finish the job until the floors are fixed, they are the one how dug up the floors. I am a black female with triple negative breast cancer. I tired through several emails and phone calls which were never answered. I had no plumbing. They were fraudulent in what they did do and what they say they were going to due. Now they are trying to take my house I paid them 1/2 (11,820)the contract cost up front before they would even start the work, 11,820. The 5 Day Notice of cure from their lawyer stated I only owed 11,820. They stated in the Lien that was filed with Hillsborough County that I did not pay them anything, and that I owed them $25,640 + 13,820 for labor when labor was included in the contract. So it was increased to 39,460 which is more than the original contract. They left me with no plumbing and I had to get another plumber who would go behind their work and finish connecting the pipes so I would have water. There is more bad stuff, how were they allowed to sent it to court when they lied. I have Pictures emails and copy of certified check that was paid. I have to file more doc for the discovery period by 02/11/22. I don not have a lawyer and few that I talked to did not care for the case. What do I do?...Read More

I am a subcontractor, I send a Notice to Owner to the address that appear on the drawings as the physical address of the owner. The notice was sent through certified mail. The UPS tracking number show the Notice to owner as been deliver to the front desk, reception area or mail room. the owner is stating she never received the notice. She is Saying i don't have no legal rights to Lien the Property. Is this correct? do i still have any rights? the GC of the job received this notice to owner....Read More
