A contractor we hired for paver hardscape installation
They stated pavers, materials and installation would be done that day but left a mountain of sand in the street and after calling them to ask why pavers had not arrived with workers as promised they said it will take at least another week for the pavers. We cancelled the job and they threatened us with mechanics lien unless we paid 450.00 for the sand. They refused to justify that much for sand and threatened legal action and it was non negotiable. We filed a complaint with ROC but they dismissed the claim saying it was a financial dispute. We don't want to pay because it is such an overcharge; and are willing to pay half that since we had to dispose of the sand ourselves; HOA requiring material on street to be removed after 72 hours. I received a partial payment, and the general contractor has asked that I sign an Unconditional Waiver Upon Progress Payment and reduce the amount of the lien by the amount of the payment. I have read from multiple sources that for Arizona owner-occupied residential projects, "Only parties who have a written contract with the owner-occupant may file a lien against an owner-occupied residential project.".
Does this mean that a subcontractor who is only in contract with the prime contractor does not have lien rights? If so, what alternative recourse does the subcontractor have to recuperate funds owed?...Read More

We are seeing more and more jobs pushed back and customers thinking they can leave their cabinets in storage with us without final payment (we collect 50% deposit) What can we do to enforce that customers do come and pick up their order in a timely manner - for example if a jobsite is shut down for months, our customers will not pick up their order, or pay for it until they are ready. Our company fabricates exterior metal wall panels for Commercial/Residential/Federal/State buildings. Almost all of our costs are incurred prior to shipping the panels to our customers. We provide shop drawings and engineering services, order the materials for the panels, and fabrication labor all prior to delivery. Since the majority of the documents for lien rights are based off of shipping/delivery dates, we generally send the preliminary paperwork upon shipping. In this case, we have provided the service for the shop drawings and engineering (customer has paid for these services), and have ordered and received the materials for fabrication (customer has failed to pay for materials - received and invoiced in November 2022). I am a subcontractor working on a commercial job in Arizona. My GC has terminated my contract without cause- (personal dispute) but the there is already a considerable amount of money already due. The pay app was due April 1st. Although I realize it is not extremely late, I am concerned about the termination of the contract and whether or not my lien rights are affected. This GC is notorious for NOT PAYING. And now I have spoken with another sub on this job, who has told me the GC is past due on 100K+ to them. This has me concerned. I do not want to miss any deadlines and lose my lien rights.
