Would it hold up in a court of law the difference in a 'signed restoration contract' versus a 'new build contract'?

I signed a restoration contract and then the project turned into a new build. Having issues with incorrect work. Contractor not following house plan and not having me sign a change orders. Would not respond with BBB. Would like to end contract with builder. Is the signed restoration contract different then a new build contract?

The scope of work for a new build contract is obviously different from a restoration contract - are you saying you and the contractor agreed to switch to a new build without signing a new contract? I'd be interested to see what the termination provisions are in the contract. Also, if you and the contractor agreed to completely depart from the scope of the first contract, you might have an argument that the contract was abandoned so that you would only owe the contractor the value of services provided. I'd need some more background to give any clearer of an answer.
