What to do about unreliable contractor?

CaliforniaConstruction Contract

Contractor has two payments and is not reachable anymore. Has claimed to show up for work, but unreliable. Only part of the work is done. What remedies do I have? How can I get part of deposit refunded?

If the contractor is licensed and you have a contract, you should look to enforce the terms of the contract, including any liquidated damages/penalty clauses that exist in your contract. You should file a complaint with the Contractors State Licensing Board as they can provide you with assistance as well.

The answer to your question will depend, in some part, on the terms and conditions of your contract.  If the contractor has truly "abandoned" your project or has otherwise violated the Business and Professions Code regulating contractors, you may indeed have an appropriate complaint with the Contractors State License Board and a claim with the license bond surety that issued the bond for the contractor. ---CN

It is critical that you document the unavailability and abandonment of the contractor. Review the contract to see if you need to give them any specific time to cure defaults and comply with any such requirement. Then file complaints with the Contractors Board and the bonding company. The name of the bonding company is listed on the CSLB website along with the information on the contractor.
