In 2017, an unscrupulous roofing company replaced my roof, but the supplier gave them the shingles on credit and the roofer did not pay them. The company placed a Mechanics Lien on my home in 2018. I am a retired woman and paying for the roof twice is outrageous. Is there anything I can do at this time to get this situation resolved? The company claims to have been in litigation with the man all this time, still with no resolution. At the time of filing, the lien was for $2756.68. I am sick of having this hanging over my head!
When the supplier sued the roofing company the supplier was supposed to record a "Notice of Lien Action" as part of the steps required to perfect the lien. If that Notice was not recorded within 395 days of the date of the Claim of Lien, then the Claim of Lien has expired as a matter of law and there is nothing to do. They also have to have sent you a copy of the Notice of Lien Action. Did they do that? Due to the amount it is highly likely they have not taken those steps to perfect the lien and the lien has expired.
