What state does a subcontractor sue a general for non-payment

ArizonaPayment Disputes

We are an AZ subcontractor building a project in AZ. The GC is in another state. We did use Levelset to file a preliminary 20 notice. We have not been paid and filed a lien notice. In our contract it stipulates any legal action will be taken in the GC's home state. We have heard that in Arizona all contracting disputes has to be heard in Arizona courts. Can someone confirm if this dispute should be herd in AZ or the GCs home state. Thank You Ray

If your contract calls for another state as the venue of any litigation, you likely are stuck in that jurisdiction. You could potentially file in Arizona and the other side may answer and implicitly waive challenging or they could file a motion to dismiss because of the venue clause in the contract.
