What if the project does not fall under one of the categories outlined by the Model Disclosure Statement delivery?

We are a Canadian company providing professional services for a company developing a neighbourhood in Point Roberts. Since we deal with the property owner directly, we would need to deliver a model disclosure statement to the property owner. However, the project does not fall under either of these two categories: 1. The project is for a commercial property with a bid of $1,000 - $60,000; or 2. The project involves repair or alteration of residential property of 4 or fewer units (bid was $1,000 or more). Since the project does not fall under either of these categories, what is our next step? Do we deliver a model disclosure statement?

In this case, no Notice to Customer is needed as you accurately put it: it's deemed "commercial" (since it's not residential under RCW 18.27) and the bid exceeds $60,000.00, so notice is not needed in this case. If it is public works, this is a different story (the claims procedure differs), but here it sounds like it's for a private entity. Finally, if you are not a registered contractor (which RCW 18.27 governs) there would never be a notice needed for you under this section. Professional services do not fall under this section.   Good luck.

As I understand your answer, no notice is required prior to filing the mechanic's lien. Is this correct?
