FloridaConstruction ContractCoronavirusLien WaiversPreliminary NoticeSlow Payment
Anonymous Subcontractor

Hello, we are EC in Florida. We are working on a project, originally we were hired by the someone working with the GC. Then the owner fired the GC and took over under their own license. We never submitted a NOC to the old GC or the new GC. With corona we stopped working there for a month, now that we have to get back to the job we still have not been paid. They want us to go back to finish the job but we are wondering legally what are our options?

First, did you serve a notice to owner? That may impact your lien right under those circumstances. Otherwise, you may have a lien right, and you almost certainly have the ability to seek payment from them through a demand letter or claims for breach of contract. You should consult with an attorney to confirm what rights you have and what your options are. Please feel free to reach out to me if you have any further questions.
