We are HVAC and refrigeration company. We did some work on a fast food restaurant in two different locations. The owner keeps promising to pay for the work that has been done to both locations. We have emailed and texted, and then met with him in person. I have all the emails and text messages stating that he will either send a post dated check or we could pick up a check at the office. We have offered him to make payments, in which he replied that he would give us the post dated checks. When I met with him at his office, he kept putting me off, stating he did not have the time or some other excuse. Since than he has not reached out or made any payments.
Filing a lien is good leverage but never a gurantee. Even after you do so, you may need someone like myself to help you execute it to get paid. I work with contractors like you to help them get paid, and I charge only if I collect. You are welcome to reach out to me at Jgrider@debt-rr.com.
Since it appears you contracted directly with the owner you have the ability to file a lien not later than the 15th day of the fourth month after the month in which your work on each property was completed, terminated, or abandoned. If you are past that timeframe you may be able to assert a consitutional lien against the properties. DO NOT let your lien deadlines pass by as liens are one of the most effective tools for payment a contractor has. In any event you should contact a construction lawyer like myself to determine the best course of action.
