We are a contractor. We put a lien on a customer for $14,000 plus. She emailed and said she would pay if we released the lien. I did that. And now she is not responding. What should we do please
You state that your customer promised to pay after your released your Mechanics Lien. Based on that promise, you released your lien. The customer failed to pay you.
First, there is no way to reinstate a lien that was released. Of course, this presumes that you actually recorded a release. If so, then you stuck with it. If not, they you may be able to find a way around it.
Second, even if your lien rights are extinguished, you may still seek breach of contract, unjust enrichment, and other remedies from this customer. All such remedies would be pursued in Court.
