I did some work for a local motel and I am still owed 750 bucks ,I did the job a year and a half ago and the motel has been sold and tore down, since then, but I recently found out that the owner bought another motel here in town,so I stopped by and the owner refuses to pay me,do I have a chance of getting the money I am still owed or should I just forget about it
Although you wouldn't be able to file a lien against any of the properties (outside of your lien deadlines) you can still bring suit for payment under a breach of contract theory as well as breach of the Texas Prompt Payment Act. Since the amount is only $750, you'd likely do well filing in small claims court.
Hello,
Unfortunately, you are out on any lien rights that you may have had.
If you want, you can still sue the former owner for breach of contract in small claims court. Your statute of limitations on that one is 4 years from the date of breach.
