Should arbitration be my next step

LouisianaCollections

Had a problem with a single contractor on three jobs. Two of these jobs were taken over by other GC's so we liened but of course listed the GC at the time that did not pay us. Both liens were filed in the City of New Orleans, one was a city property and the other a state. they received their CO without clearing the lien so I am going to take the next step. Was going to go through arbitration, is that the path you would recommend? Steve Weicks 985-768-9137

Steve: It would depend upon the written contract you have with the General Contractor, and whether or not it provides for arbitration. Arbitration is not something I typically recommend if I can get away from it. My main concern with it is the failure of appellate rights and the lack of a record. Additionally, one of the things which initially had made arbitration popular in the construction world was its "quick" time period as compared to litigation, which has somewhat been diminished in my experience.
