That's a good question. In Rhode Island, the statutory retainage rules are generally the same for public and private projects. Pursuant to § 37-12-10.1 of the Rhode Island General Laws, up to 5% retainage may be withheld from progress payments on projects that are subject to the state's mechanics lien laws or public works regulations.
