RFI who pays for changes?

WashingtonConstruction Contract

I am a sub contractor working on a large trash enclosure for a GC in Seattle. The engineer had to reconstruct the wire mesh and framing because manufacturers don't make mesh in large sizes. Due to the changes it has increased the job with a change order of $42k. The GC is rejecting the change order. And the GC wants the changes to be made but they do not want to pay. What do we do? They are alluding to us delaying the job.

It depends on your written contract with the GC, but if they insist, do it under protest (protest in writing) with your estimate for the $42K attached, before you do work. You might want to consider notice to the Engineer and Owner too. Carefully follow the claims procedures of your written contract (make sure you have read it and understand it).

As long as the change order was made clear to the GC in advance and they assented to it, per terms of the contract, you should be fine. If there are other issues at play here, please let me know or contact me directly.
