we are a concrete ready mix company and the contractor forgot to cancel the order. The truck was loaded and was out for delivery before he remembered to cancel the job, so the concrete got dumped (we always try to send to another job whenever possible, however this was not the case. The contractor has not paid us. Can we lien the property in this case?
If the concrete never made it to the job or was never incorporated into the work of improvement to benefit the owner, then a lien would be improper.
