Opening single member LLC, operating with husbands license

South CarolinaLicenses

My husband is dissolving his current business. I (wife)would like to open a single member LLC in SC in my name, but use my husbands residential builders license. He is under the assumption he can add me as a signer to his license. He would not be a member. The business would be single member LLC only in my name. He would be an employee with salary . Is this possible?

To use a qualifying party's license for your South Carolina construction business, that qualifying party must be employed full time at the business and must have some a managerial position. They'll have to be responsible for directing or reviewing work in order for their license to qualify the business. But, at least as far as I can tell, they don't have to be a member of the business. For additional questions, here's a great resource: Frequently Asked Questions - General & Mechanical Contractor Questions Regarding Initial Application for Licensure. Plus, reaching out to the South Carolina Department of Labor, Licensing and Regulation could clear things up, too.
