Can the NOC be signed by an authorized representative of the owner or does the NOC need to be filed/signed by/through "SunBiz" ?

The NOC can be signed by anyone with authority to bind the corporation on behalf of whom it is signed.

Under Florida Law, specifically F.S. 713.13(1)(g), a Notice of Commencement can only be signed by an Owner unless there is a construction loan, then the lender assumes the Owner's duty to sign. Prior to 1991, an Owner's agent was empowered to sign. Also, the NOC must be recorded in the public records of the County where the project is located. Some Counties have provide the ability to record NOC's electronically. You do not file through "Sunbiz".
