Hi, Can a materials supplier from the UK file a mechanics lien in the state of California against a US contractor or sub-contractor working on a construction project in California? Thanks Paul

A materials supplier can record a mechanics lien against the property that will have the materials incorporated into the work of improvement. The materials supplier needs to provide a "direct product" as opposed to a component of the materials supplied, such as a window frame as opposed to providing the component glass. The materials supplier also needs to serve a preliminary notice on the participants, owner, lender, contractor. If you want to assert lien rights, I suggest you discuss this with an attorney familiar with construction remedies.

The answer is yes, provided preliminary notice has been given to the owner and lender if any.
