mechanics lien and breech of contract

WisconsinMechanics Lien

Hello, I hired a window company for a patio door and front window. They were to be made to my custom size. I paid $3k down. The company sent out a tech to do a measurement on 4/26/21 and no work has been done since. Installation has been cancelled on me twice on very short notice and I cant get to speak with a manager or get my calls returned. I have paperwork that states the installation will be scheduled when all of the product is available. Both install dates were cancelled because the door was not available yet. Would this be a breach of contract on the window companies part? If I'm able to get my down payment back from my credit card and tell this window company I want to cancel the project; can the window company place a lien on my home?

Many small contractors are struggling to obtain raw materials at fair prices right now. Labor shortage is also a problem. Your situation is common. The best way to cancel the contract is by the terms of the contract. I suppose it is not impossible for the contractor to file a lien or that it would be successful under these facts, but a lien seems unlikely. Could you send me a copy of the contract and we can discuss? There may be an opportunity to push them to finish the job... I assume you would prefer to have your patio door and front window done asap, and do not want to cancel the contract. Feel free to contact me through my website, MichaelJohnsonLegal.com.
