Looking for attorney in San Antonio area to handle enforcement of lien for 5 apartment complexes in San Antonio as well as filing suit against the prime contractor to recover amounts owed above the lien amounts. Also, once a lien has been filed, can the amount of the lien be changed based on miscalculations or other administrative errors?

Good morning, regarding your question, a lien claimant generally cannot change the amount (or amend) a lien in Texas. However, a lien claimant can file additional liens as needed so long as the statutory deadlines have not passed, and the other statutory requirements are met. Once the new lien is filed, in most instances the claimant will want to release the
original lien to avoid a wrongful lien claim or similar action from the debtor.

We are outside of San Antonio but would be happy to help with your lien enforcement action. Feel free to reach out if you have additional questions. Thanks, Mario Lamar, Attorney at Allen Bryson, PLLC, 4131 N. Central Expwy, Suite 900, Dallas, Texas 75204 (214-586-0722).
