We are a subcontractor (based out of Florida) that started and finished a project for a general contractor on a project located in Georgetown, DE. We have not been paid at all since we started and finished our work. According to the Owner, the Contractor is struggling with funds. The Owner does not want to pay because they stated that they have already paid the contractor for funds that the general contractor should have been paid to us. I would prefer to file a lien than to go through mediation/litigation with the contractor that appears to not have finds. Could anyone assist?
