Just sent an intent to file lein paper work... i got a response saying "go to arbitration " So how does that get set up? Did levelset coordinate that or is that left for me to figure out? Or do i not even respond? And just let the lein take effect in 10 days? Any help would be great thanks!
Arbitration is irelevant ... You have a right to file a mechanics' lien even if you contract requires you to arbiitrate disputes. However, a notice of intent to file a lien does not create a lien. You need to file an actual mechanics' lien claim and perfect that lien by propoerly serving it on the owner. The requirements for a mechanic's lien and the perfection of that lien are quite complex. They are also strictly constred by the Courts. I therefore recommend that should review the Pennsylvania Mechanics Lien Statute before you begin or that you hire an attorney to assist you with the filing and perfection of your lien.
