Is the date the lien rights expire affected by subcontractors work?

Minnesota

We completed a job work on a job add some cooling only rooftop units to a car dealership on 7/22/22, but one of the subcontractors we hired did not complete their portion on the work until 8/8/22. Which date should I use to determine when the lien rights expire?

If the subcontractor was performing work within your contracted scope, which I assume is the case based on your question, you should be able to use the subcontractor’s last date of work.

Your lien rights expire 120 days after your last efforts. The subs work expires at a different date than yours.

It is always best to consult an attorney for certainty on the last day of work for a mechanics’ lien. Courts enforce strict compliance to the dates which makes it risky to guess.

To answer this question, it is necessary to know who the parties are, what each party’s scope of work consisted of, and when each party’s scope was complete. For example, if the sub was performing work that was part of the questioner’s scope of work, the questioner’s work was likely not complete on 7/22 but rather was completed on 8/8 or later, when the sub completed that portion of work it did for the questioner.
