Is it typical to give a lien waiver to an architectural/engineering firm during the A/E phase of a project as you would to a subcontractor during construction?
It is good practice to collect lien waivers from all parties who would otherwise have the ability to lien the property. Conditional waivers may be collected prior to making payment, or unconditional waivers commensurate with payment. Architects, engineers, and other design professionals have lien rights in most states, including New York, so obtaining waivers is an easy way to provide more protection to the property.
