Is it acceptable to assert intent to file a lien, when legal authority to do s is uncertain?

WE are a professional services firm. If we are uncertain whether the time limit for a lien has ended, is there any legal problem with asserting we intend to file a lien? Is the answer state specific?

Hello,

In Texas, you cannot file a lien against a property unless you provided labor or material for the improvement of said real property. The facts presented here to not lead me to believe you have the basis for a lien.
