We had a lien placed on our home because our insurance never paid them for the service. We got a lawyer and sued our insurance company. We just got served papers by the the mitigation company that placed the lien on our home and a day later found out our insurance is bankrupt. Any ideas of what might happen? Our lawyer is defending us when it goes to court
LIGA will take over the claim. The issue is that you cannot collect penalties and attorneys fees against LIGA like you can a normal insurer. I would recommend continuing with litigation and working with the contractor to reach a settlement. I would also carefully check the contracts, as there may be a better answer within those documents.
