In California, is a Home Improvement Contract applicable to a new construction in a diaster area?

My wife and I are the property owner and want to contract for the installation of hardwood floors and carpet. The flooring contractor has presented us with a Home Improvement Contract. Since our home is a new construction project in the Tubbs Fire Diaster Area, is a Home Improvement Contract what we should be signing? Thank you Bruce and Kathy McConnell

A Home Improvement Contract is designed for the protection of consumers. It typically contains terms required by statute that give you notice of your rights under construction law and terms that protect you from onerous provisions often contained in a typical construction contract. Unless there are specific terms in the contract that concern you, the Home Improvement Contract form should benefit you.

California contracts over $500 must be in writing. In California contracts to build a home or improve a home or home improvement contracts and carry the same protections this is as opposed to commercial building construction home improvement contracts call for distinct protections including Lien rights, recission rights as well as bond rights.
