If we supplied materials on a project for two addresses on the same invoice, are we able to lien 50% of the invoice for one address and lien the other 50% for the other address?
Your lien should only be for the materials/labor actually used at the specific property you are placing a lien on. You should discuss this case with an attorney before proceeding as there are significant penalties for spurious liens.
Hi Suzy, I agree with Casey above that in almost all circumstances a lien should be filed for each specific property for work and materials that benefited each specific property. The outstanding balance for unpaid work/materials will need to be apportioned between each property. This may not be an easy task, so you may want to reach out to an attorney to discuss in more detail.
In some very limited circumstances a "blanket lien" can be filed for more than one property. However the rules are very restrictive and highly dependent on the facts and circumstances of the work and properties invovled.
In most cases, it is in a parties general interest to file mutiple liens against multiple parties for various reasons. If you have any additional questions or want to discuss further feel free to reach out to our office.
Generally, yes that would be the thing to do. You could not lien for the full amount for both properties or only on one.
